1. Introduction

1.1 These Terms & Conditions (“Terms”) govern the use of the website [www.iSurvived.one] (the “Site”) and any contributions you make through the Site to support the individual, [iSurvived] (the “Recipient”).
1.2 The Recipient is an individual who has experienced domestic violence and sexual assault, and is raising voluntary financial support for herself. The Site is not a registered charity, organisation, foundation or trust.
1.3 By making a contribution via the Site, you confirm that you have read, understood and accepted these Terms. If you do not agree with any of these terms, please do not make a contribution.

2. Nature of the contribution

2.1 All contributions made via the Site are voluntary gifts (sometimes referred to as “donations” in ordinary usage) from you to the Recipient.
2.2 Because the Recipient is an individual and this is not a charitable fund, your contribution is not to a charity, registered NGO or similar organisation, and you should treat it as a personal gift.
2.3 You agree that the contribution is given freely, without expectation of goods, services, or any legal claim in return. You will receive no rights or benefits (other than those the Recipient may choose to provide voluntarily) and you waive any right to demand goods or services in return.

3. Use of funds

3.1 The Recipient may use the funds as she sees fit, to support her recovery, wellbeing, living costs, future goals, or other personal purposes.
3.2 You understand and accept that you have no control, claim or entitlement over how the funds are used once contributed.

4. No refunds

4.1 Because each contribution is a voluntary gift given to an individual, no refunds will be available. Once a contribution is made and accepted by the Recipient (or her payment processor), the gift cannot be reclaimed, reversed or refunded by the Recipient or the Site.
4.2 You agree that you will not make any claim for a refund, reversal or return of your contribution, and will not hold the Recipient or the Site liable if you change your mind.

5. No liability / disclaimers

5.1 To the fullest extent permitted by applicable by UK law, the Recipient and the Site disclaim all liability for any loss, damage, cost or expense arising directly or indirectly from your contribution or your use of the Site.
5.2 Nothing in these Terms shall exclude or limit liability for death or personal injury resulting from negligence of the Recipient or the Site, or for any other liability which cannot be excluded by law.
5.3 You acknowledge that making a contribution involves financial risk, and you rely entirely on your own judgment in doing so.
5.4 The Recipient does not guarantee any particular outcome, result or benefit from your contribution.

6. Eligibility & legal status

6.1 By contributing, you represent and warrant that you are at least 18 years old and have legal capacity to make the contribution under the laws of your jurisdiction.
6.2 If you are contributing from outside the United Kingdom, you are responsible for ensuring compliance with all relevant laws and regulations in your country of residence.
6.3 Because the Recipient is not a charity, no charity registration or regulatory status applies; you should not rely on charitable tax benefits being available.

7. Governing law & jurisdiction

7.1 These Terms shall be governed by and construed in accordance with the laws of England & Wales.
7.2 You and the Recipient submit to the non-exclusive jurisdiction of the courts of England & Wales.

8. Severability

8.1 If any provision of these Terms is found by a court of competent jurisdiction to be invalid, illegal or unenforceable, that provision shall be limited or removed to the minimum extent necessary so that these Terms otherwise remain in full force and effect.

9. Changes to these Terms

9.1 The Recipient reserves the right to amend these Terms at any time by posting the revised Terms on the Site with a new “Last updated” date. Your continued use of the Site (including making contributions) after such posting constitutes your acceptance of the revised Terms.
9.2 It is your responsibility to review the Terms periodically.
